These Terms of Service ("Terms") govern your use of GitPulse's GitHub analytics service ("Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

GitPulse provides:

• GitHub repository and team analytics
• Activity tracking and reporting
• Automated dashboard generation
• Team performance insights

3. Account Requirements

3.1 Eligibility

• You must be at least 13 years old
• You must have a valid GitHub account
• You must have authority to install apps for your organization

3.2 Account Security

• You are responsible for maintaining account security
• Keep your credentials confidential
• Notify us immediately of unauthorized access
• You are responsible for all activities under your account

4. Acceptable Use

4.1 You MAY:

• Use the Service for legitimate business purposes
• Access analytics for repositories you have permission to view
• Share dashboards with your team members
• Export data for internal reporting

4.2 You MAY NOT:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Attempt to breach security measures
• Reverse engineer or copy the Service
• Use the Service to harass or harm others
• Resell or redistribute the Service
• Overload our systems with excessive requests

5. Subscription and Payment

5.1 Pricing

• Free tier: Limited features as described
• Paid tiers: Monthly or annual subscription
• Prices subject to change with 30 days notice

5.2 Billing

• Payments processed securely through Stripe
• Subscriptions auto-renew unless canceled
• No refunds for partial months
• Annual plans: Pro-rated refunds at our discretion

5.3 Free Trial

• 14-day free trial for paid features
• No credit card required for trial
• Automatic downgrade to free tier after trial

6. Data and Privacy

• We process data according to our Privacy Policy
• You retain ownership of your data
• We have a license to use data to provide the Service
• You're responsible for having rights to the data

7. Service Availability

7.1 Uptime

• We target 99.9% uptime (excluding maintenance)
• No SLA for free tier
• Enterprise tier includes custom SLA

7.2 Maintenance

• Scheduled maintenance with advance notice
• Emergency maintenance as needed
• Updates may temporarily affect availability

8. Intellectual Property

8.1 Our Property

• GitPulse owns all Service IP rights
• This includes code, design, and trademarks
• You may not copy or redistribute our work

8.2 Your Property

• You retain rights to your data
• You grant us license to process your data
• This license ends when you delete your account

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Service provided "AS IS" without warranties
• We're not liable for indirect damages
• Total liability limited to fees paid in last 12 months
• Some jurisdictions don't allow these limitations

10. Indemnification

You agree to indemnify and hold GitPulse harmless from claims arising from:

• Your use of the Service
• Violation of these Terms
• Violation of any rights of others
• Your data or content

11. Termination

11.1 By You

• Cancel subscription anytime
• Request account deletion
• Uninstall GitHub App

11.2 By Us

• For Terms violation
• For non-payment
• For illegal activities
• At our discretion with notice

11.3 Effect of Termination

• Access to Service ends immediately
• Data deleted per Privacy Policy
• No refund of current period fees
• Survival of applicable Terms sections

12. Modifications

• We may update Terms with 30 days notice
• Material changes require acceptance
• Continued use implies acceptance
• Check Terms regularly for updates

13. Governing Law

• Governed by laws of Delaware, USA
• Disputes resolved in Delaware courts
• You waive jury trial rights
• English language governs

14. Miscellaneous

• Entire Agreement: These Terms are the complete agreement
• Severability: Invalid provisions will be modified minimally
• Waiver: No waiver unless in writing
• Assignment: You can't assign rights; we can
• Force Majeure: Not liable for events beyond control
